Does the IRS Have Jurisdiction Outside the U.S.?

Zuckerman Law, LLC Feb. 9, 2023

Sign on IRS headquarter buildingAccording to the most recent estimates from the U.S. Department of State, there are nearly 9 million U.S. citizens living abroad. Under the law, U.S. citizens or resident aliens living and earning in foreign countries are required to file their U.S. taxes and report their income information annually. However, there are specific rules addressing filing income, gift, and estate taxes for U.S. expatriates.

At Zuckerman Law, LLC, I’m committed to offering experienced legal counsel and advocacy to clients in tax-related matters. As an experienced Florida tax law attorney, I can enlighten you about the jurisdiction of the IRS outside of the U.S. and guide you through the process of filing your taxes. My firm proudly serves clients across Fort Lauderdale, Florida, and surrounding areas throughout South Florida, including Miami, Boca Raton, Aventura, Hollywood, and North Miami Beach.

When Is Filing Taxes Outside the U.S. Required?

As mentioned earlier, if you are an American citizen or resident alien living abroad, you are under obligation to file your U.S. federal tax return and pay U.S. taxes on your earnings, regardless of where you live. The only possible option to avoid paying your U.S. taxes is by renouncing your American citizenship.

Filing Extensions When You Are Outside the U.S.

Generally, tax filings are due on April 15 of every year, though it can be delayed if it falls on a holiday or weekend. Also, there is an automatic two-month extension for American expatriates until June 15. The extension applies to U.S. citizens and resident aliens who live and earn overseas and those on military duty outside the United States.

Furthermore, for the calendar year 2022, you must file your federal tax return and pay any tax due by April 18, 2023. Failure to file your taxes when due may result in fines, interests, penalties, and other legal repercussions.

Does the IRS Have Jurisdiction Outside the U.S.?

As an eligible American taxpayer, the Internal Revenue Service (IRS) has jurisdiction over you. The jurisdiction of the IRS applies to the following:

  • Residents of the United States

  • Non-residents earning money in the United States

  • American citizens living and earning money overseas

As a result, failure to pay taxes on your income, property, and capital gains may result in IRS issues and other possible penalties. A seasoned lawyer can help determine your eligibility to pay taxes and enlighten you about your available legal options.
